DRIVING OR CONVICTION FOR DRUG OFFENSES

In the court proceedings, you may be eligible for programs to earn a dismissal on the case. If not, there are strategies to re-analyse and reweigh the substance to help you present evidence in court to dispute what the officer or crime lab speculates yout had or were doing with the narcotics.

If you are accused or convicted of a drug offense, the DMV will consider you a safety risk and can suspend your privilege to drive for six months, or longer. There are limitations to what the DMV can do, but if you don’t challenge its actions, you will be required to complete the entire suspension. With a pending criminal court action, you may not want to jeopardize the evidence in that action by testifying at the DMV. In certain circumstances, you may want to use the DMV hearing to help you in your court case.
